ATLANTA (AP) ? Part of Alabama's immigration law that ordered public schools to check the citizenship status of new students was ruled unconstitutional Monday by a federal appeals court that also said police in that state and Georgia can demand papers from criminal suspects they have detained.

The 11th Circuit Court of Appeals ruled that the Alabama schools provision wrongly singles out children who are in the country illegally. Alabama was the only state that passed such a requirement and the 11th Circuit previously had blocked that part of the law from being enforced.

Judges said fear of the law "significantly deters undocumented children from enrolling in and attending school ...."

Both private groups and the Obama administration filed lawsuits to block the law considered the toughest in the country.

The court, however, upheld parts of immigration laws in Alabama and Georgia allowing law enforcement to check documents for people they stop.

And the panel left in place an injunction that blocks a section of the Georgia law that allows for the prosecution of people who knowingly harbor or transport an illegal immigrant during the commission of a crime.

In Alabama, the judges sided with opponents of the law on other key points, including challenges to sections that made it illegal to harbor illegal immigrants; made it a crime for illegal immigrants to seek work; and made it a state crime for people in the country illegally not to have registration documents.

The decisions follow a recent U.S. Supreme Court ruling upholding parts of a similar law in Arizona. The Atlanta-based court referenced that decision in its opinion to lift the injunction on the suspect verification section.

Georgia and Alabama are among several states that have enacted anti-illegal immigration laws in recent years. Proponents have argued they are necessary in part because of alleged federal inaction. Opponents have argued that many of the laws are punitive to immigrants and that policy must be steered by the federal government.

Omar Jadwat, an American Civil Liberties Union attorney involved in challenging similar laws in Alabama and Georgia, said the judges stuck down the schools provision "in pretty robust terms" and effectively opposed the sponsors' stated idea of forcing illegal immigrants to "self-deport" by making their lives too difficult.

"The original idea behind the law, that these provisions would all work together to allow the states to aggressively identify and prosecute undocumented residents, has been shot down," said Jadwat.

Alabama Republican Gov. Robert Bentley disagreed, saying the court upheld the "essence" of the law.

"The core of Alabama's immigration law remains that if you live or work in the state, you should do so legally," said Bentley, who signed the measure. "It is time now to move past court battles and focus on enforcement of Alabama's law."

School officials said many Hispanic parents quit sending their children to class immediately after Bentley signed the law, and some families left the state in fear. Local education systems have said many children returned to class, and some immigrant families moved back to Alabama after courts blocked many provisions in the law.

In a statement, Georgia Attorney General Sam Olens said he was generally pleased with the ruling for his state but disagreed with the court on the section dealing with transporting illegal immigrant that is still being blocked.

Jadwat said the organization will continue to challenge so-called "show-me-your-papers" provisions of the state immigration laws.

"The court today rejected many parts of Alabama and Georgia's anti-immigrant laws, including attempts to criminalize everyday interactions with undocumented immigrants and Alabama's callous attempt to deprive some children of their constitutional right to education," he said in a statement. "The court explicitly left the door open to further challenges against the 'show me your papers' provision, which we will continue to fight."

The protein ? nerve growth factor (NGF) ? is also found in human semen, suggesting that it may play a previously unsuspected role in human fertility.

Whereas many animals, including humans, cattle and mice, produce eggs as part of a cycle of spontaneous ovulation, others ? including llamas, camels, rabbits and koalas ? are ?induced ovulators? that need a chemical stimulus. In 2005, Gregg Adams, a veterinary surgeon and reproductive scientist at the University of Saskatchewan in Saskatoon, Canada, and his colleagues showed that in llamas, the stimulus was in the seminal fluid². In the latest study, published this week in the Proceedings of the National Academy of Sciences¹, Adams led a team that identified the chemical as NGF.

Although human women do not require NGF in semen to ovulate, Adams says that the protein could still have a direct effect on human fertility. Earlier this year, he published a paper³ showing that llama seminal fluid shortens the ovulation cycles of cows and seems to stimulate the development of the corpus luteum ? a structure inside the ovaries that forms after an egg has been released and secretes hormones vital to pregnancy.

In some cases, NGF could explain why some couples find it difficult to conceive, says Adams. A couple could have fertility problems if either the man failed to produce enough NGF in his semen or the woman lacked the receptors to detect and respond to it, he says.

Previous research has already shown that NGF and similar proteins are made in human ovaries⁴ and have a local effect on how the eggs develop, says Sergio Ojeda, a neuroscientist at Oregon Health and Science University in Portland. But Adams believes the latest study indicates that seminal NGF may be acting like a hormone ? making its way through the walls of the vagina, into the blood and all the way to the brain, where it stimulates the release of other hormones that affect the ovaries.

?The beauty of this paper was that they weren?t looking for NGF,? says Ojeda. The research, he says, is ?extremely exciting because, in the past, the scientific community has sometimes been guilty of only going with the established dogma".

During the past decade at UNH, the cost of attendance rose 147 percent for in-state students and 113 percent for out-of-state students. At Plymouth State University and Keene State College, the 15-year increases were more than 130 percent for in-state students and more than 100 percent for out-of-staters. SAN FRANCISCO (AP) ? "The Tonight Show" has laid off about two dozen workers, prompting host Jay Leno to accept a pay cut to spare other staffers as NBC clamps down on expenses.

NBC Universal imposed the cutbacks Friday, according to a person familiar with the moves. The person asked not to be identified because NBC Universal hadn't officially disclosed the cost cutting.

The payroll purge affected about 10 percent of the roughly 200 people who work on "The Tonight Show," still the top-rated late-night program. Viewers shouldn't notice any changes in programming at "The Tonight Show," the person said.

NBC Universal is trying to improve its financial performance under the ownership of Comcast Corp., which bought the entertainment company last year.

Leno had been making between $25 million to $30 million annually as the host of "The Tonight Show." His salary will be reduced to about $20 million after making the job-saving concessions. Leno also brings in substantial income touring as a stand-up comedian.

"Jay's foremost concern is for the wonderful people who work with him at 'The Tonight Show,'" said Bruce Bobbins, a spokesman for Leno. "He did what was necessary to ensure their well-being."

Several other staffers on "The Tonight Show" also absorbed pay cuts.

David Letterman, the host of a rival late-night show on CBS, accepted a significant pay cut in 2009.

The show's cost-cutting measures were first reported by Deadline Hollywood, a website that tracks the entertainment industry.

Comcast bought a controlling interest in NBC Universal for $6.2 billion in cash and several cable-TV channels valued at $7.25 billion. Besides its TV network and several cable channels, NBC also owns the Universal Pictures movie studio and theme parks.

Comcast, which is based in Philadelphia, makes most of its money selling cable TV and high-speed Internet access.

Despite its solid ratings, "The Tonight Show" hasn't been a big moneymaker. That prompted the cuts Friday, which are expected to trim the program's weekly budget by about $600,000, or 25 percent, to $1.7 million. That's back to its levels of a few years ago.

Leno outmaneuvered Letterman to succeed Johnny Carson as "The Tonight Show" host in 1992 and remained in one of television's most sought-after jobs for the next 17 years. At NBC's behest, he left the show in 2009 and was replaced by Conan O'Brien. After a few months hosting his own show in an earlier time slot, Leno returned as "The Tonight Show" host in 2010 in a decision that provoked a nasty fight between O'Brien and NBC.

O'Brien now hosts a late-night talk show on TBS

During Leno's brief stint hosting his prime-time program, his show's weekly budget escalated and wasn't reduced significantly to reflect his return to the late-night slot until now.

Facebook tanks on 1st day early investors can sell

Facebook?s stock price fell to an all-time low Thursday as the first part of a so-called ?lockup? period for key investors in the company came to an end.

The period, which lasted for 90 days after the social network?s public offering on May 18, prevented some early investors and insiders from selling millions of shares they own in Facebook.

Those early investors include Accel Partners, a venture capital firm, and Wall Street bank Goldman Sachs. Insiders include Facebook board members such as PayPal co-founder Peter Thiel and Reid Hoffman, who is co-founder of LinkedIn.

Facebook?s stock price took a battering Thursday morning, although it?s unclear whether the decline was due to insiders selling their shares or other shareholders selling on concerns that insiders could unload their shares in the company. Any stock sellers have three business days to report their sales.

Lockup periods prevent insiders from selling their shares too close to a public offering, causing volatility in a stock.

By afternoon trading Thursday, Facebook?s stock price was down over 5 percent at $20, having fallen 7.1 percent to an all-time low of $19.69 in mid-morning trading. Facebook stock price has now lost 48 percent of its value since its debut in May at a $38 offering price.

Some 270 million shares owned by early investors became available for selling Thursday -- over half the 421 million shares that Facebook sold in its IPO in May.

But Thursday?s expiration is only the start of a worrisome period for Facebook shareholders.

This fall over 1.2 billion shares will be available for sale as a second lock-up period for the stock expires, flooding the market with Facebook shares and potentially reducing the value of the company?s stock. The final lockup period ends next May, one year after Facebook?s IPO.

Facebook has faced a difficult three months since its public offering, which was one of the most-anticipated IPOs in history.

The company suffered through a bungled public offering, marred by trading glitches on the Nasdaq stock market. Its share price hasn't traded above $38 since its debut, leading critics to say the underwriting banks set the price of the offering too high and sold too many shares to the public.

Investors are also worried about Facebook's ability to make money from its users, many of whom now access the site from mobile devices where the company derives little advertising revenue.

Mark Hawtin, investment director of GAM, an asset management firm, made the bullish case for Facebook on CNBC Thursday, saying Facebook will eventually find a way to monetize its almost 1 billion users.

I make no secret of the fact that this soup is inspired by the infamous Baba Ganoush ? the Middle Eastern dip.? I love the smoky taste that permeates the flesh of the eggplant, and the contrasting flavours of the lemon.? This soup is so satisfying, warming and tasty ? a perfect and impressive low fat soup for all occasions, and pretty easy to make too !

Serve with croutons, or crunchy bread of your choice.

Serves 3 to 4

INGREDIENTS

olive oil for frying

1 large eggplant/aubergine

2 cloves garlic

1 chopped tomato

1 tsp curry powder

4 cups (1 ltr) water

1 heaped Tbsp vegetable stock granules

salt to taste (don?t bother omitting this, as it won?t taste good without it)

juice of ? lemon

1 Tbsp chopped parsley

1 Tbsp freshly chopped mint

1 Tbsp freshly ground pepper

METHOD

1. Firstly, pierce a large roasting fork into the flesh of the aubergine/eggplant, just below the stalk. Then place the aubergine over a naked flame, and turn it around every minute or so in all directions. Make sure you have a large plate by your side so that you can place the aubergine on it whilst you turn it and pierce the fork on the opposite side.? Take care, as it will be hot.
2. When the skin begins to scorch and wrinkle, rotate the aubergine until all the skin is scorched.? Then allow to cool.
3. Remove the peel ? it will come off in small pieces, but don?t despair.? When peeled, cut the flesh into 3 to 4 pieces, place in a bowl and set aside.
4. Next, in a saucepan fry your garlic in olive oil on a low to medium heat, ensuring it doesn?t burn.
5. Now add the chopped tomatoes and curry powder. Continue to mix, and then add the chopped cooked aubergine.
6. At this point, add the rest of the ingredients, except for the water, lemon juice and herbs.? Mix, and then add 1 cup of water, and allow to simmer gently for 5 minutes before you add the rest of the water, again one cup at a time, with 5-minute intervals in between.
7. Finally, add the lemon juice and herbs, and process until smooth. Taste for salt ? it may need more.
8. Meanwhile, Bon App?tit.

The term ?Cloud computing? sounds intangible, and that?s just the point.

?Cloud computing? refers to access to software that is accessible via subscription over the Internet. Programs that reside in the Cloud are actually housed on the servers of the company that owns the software and which provides subscription access. Unlike traditional software, such as word processing or spreadsheet programs that are stored on your computer?s hard drive, programs that reside in the Cloud never have to be installed, updated or uninstalled from your computer. That?s the beauty of the ?Cloud.?

Why move to the Cloud?

Why would you want your software to be housed on the Cloud? Several good reasons come to mind:

• You don?t have to install the program, so you can use software that requires greater speed or memory than your desktop or laptop might possess.
• Because the software is stored on the Cloud, it doesn?t hog memory or bog down your computer.
• You don?t have to worry about updating the software; the tech staff at the company providing the software takes care of doing that.
• Since you access the software via the Internet (and a secure password), you can access your software (and possibly your related files) from any computer, anywhere you have an Internet connection.
• Since your access is via subscription (usually monthly or annually), your costs are much less than if you were to purchase a private license for the program.
• When you no longer want or need the software, cancel the subscription. There is no software to uninstall on your computer.
• If there?s a problem with the software, your subscription includes access to technical support. It?s the provider?s responsibility to fix the bugs, and you don?t have to download patches or new versions.

Starting to see the appeal? Cloud computing programs offer extremely flexible access to powerful programs without the hassles of maintaining the software on your own computer. If you?ve ever suffered through a lengthy software download (especially one that needed to be done over several times), you?ll understand the appeal of being able to ?visit? your software instead of needing to have it all on your hard drive.

What kinds of programs reside in the Cloud? Over the last decade, a growing variety of programs are available via Cloud computing. Most, if not all, of the productivity and networking programs I?ll talk about in the remainder of the book are Cloud computing programs. Here are just some of the types of programs provided via Cloud computing:

• Calendar programs, such as Google Calendar and Tungle
• Email programs, such as Constant Contact
• Web audio/video programs, such as AudioAcrobat
• Conferencing programs, such as GoToWebinar
• Shopping cart programs, such as 1ShoppingCart
• Data storage programs, such as Carbonite
• Online job management programs, such as Elance
• Benefits administration programs, such as BaseOnline.com

What about security on the Cloud?

If the idea of having your valuable and proprietary data residing in the Cloud worries you, there are steps you can take to set your mind at ease.

First, make sure that you understand the individual service provider?s privacy policies, terms of use, intellectual property safeguards, and recommended methods for assuring the security and integrity of your data.

Secondly, always back up essential information. This can mean creating a print-out, saving a Web-based document as a file or a screen shot, or copying essential information to your hard drive or an FTP (File Transfer Protocol) storage site. An FTP site allows you to store and share documents or files that are too large for regular email. Yes, FTP sites are also Cloud computing sites?an example is www.4shared.com, but there are many similar sites.

Third, be certain to safeguard your password. Realize that when you share access to your Cloud computing sites with an administrative assistant or colleague, they may gain access to your billing and credit card information unless the site allows for different levels of access. Some Cloud computing sites offer a group membership, so that you can provide access to several employees or partners while keeping your own account information private. Other programs make it possible to designate an ?administrator? who can access everything except the billing/payment information. If you must share your password with an assistant, keep track of which passwords have been shared and be sure to change your password if your relationship with the assistant ends.

Cloud computing programs can boost your productivity by giving you access to powerful software without the hassle of downloads and updates. You save time, reduce the in-house needs for online storage, and reduce your dependence on hired computer professionals. Just think?no more losing part of a day as your IT consultant tinkers with the settings to make sure a newly downloaded program doesn?t wreck your network!

Small businesses and solo professionals also benefit by gaining access to valuable online services and software which would be prohibitively expensive to license on an individual basis, and which would require significant investment in servers and personnel to install and manage in-house.

NEW YORK (AP) ? Friends and admirers of Marvin Hamlisch will gather Tuesday morning in New York City to bid farewell to the celebrated songwriter hailed as "the people's composer."

His funeral was to be held at Congregation Emanu-El, a prominent Upper East Side synagogue. The composer died Aug. 6 in Los Angeles at age 68.

Hamlisch composed or arranged hundreds of scores for musicals and movies, including "A Chorus Line" on Broadway and the films "The Sting," ''Sophie's Choice," ''Ordinary People" and "The Way We Were."

He won three Oscars, four Emmys, four Grammys, a Tony, a Pulitzer and three Golden Globes.

His versatility and ear for musical hooks meant he was as comfortable writing songs for Barbra Streisand as he was for a light Woody Allen comedy.

Obama finally beats Bieber as Klout score admits real world

SAN FRANCISCO (Reuters) - Until recently, Justin Bieber was more influential than Barack Obama -- at least in the world of Klout, the controversial Web startup that claims to measure people's online influence using an algorithm.

Not any more.

Klout said on Tuesday it has overhauled its Website and rejigged its algorithms, mostly by pulling in data from Wikipedia entries, to better reflect a person's status in the real world.

The move toward calculating offline influence is a tricky but expected step for a company that divides opinion, and gets tongues wagging, like practically no other in Silicon Valley.

Since 2008, the firm has tagged social media users with a single number, between 1 and 100, intended to measure their influence. The Klout Score, as it is known, is now based on 400 variables, including how many Twitter followers someone has, and how often or likely it is for their Twitter or Facebook posts to get re-circulated.

As well as changing the algorithm, chief executive Joe Fernandez said, Klout also now analyses LinkedIn profiles, so a user who describes themselves as a company "vice president" or other high-level title may find their Klout score boosted.

The overhaul, which began in January, was part of the company's effort to address critics who pointed to Bieber as a prime example of why quantifying online influence was, at best, irrelevant. The teenage pop singer, with his army of 26 million Twitter followers who retweet his every word, had a Klout score that dwarfed that of the U.S. president.

"We heard the common complaint, 'Klout's interesting, but what about people who are influential in the real world?'" Fernandez said one recent morning in his company's cavernous underground office in San Francisco.

But Fernandez has stuck to his belief that personal influence, that intangible currency of social networks, can be crunched into a number.

As a result of the new algorithm -- which takes into account the number of references in a person's Wikipedia page -- President Obama's Klout score has finally topped Beiber's, four years after Klout launched, Fernandez said.

"Barack Obama is hugely important," Fernandez said, deadpan. "He's referenced everywhere, and that gives him a higher score."

The social media analytics company now sucks in 12 billion bits of data every day from social networks including Facebook, Google Plus and Tumblr, up from 1 billion just months ago. As part of the revamp, most users will see a bump in their scores, according to Fernandez.

Home Depot sees rosier year ahead as profit climbs - Business Wire ...

ATLANTA ? The Home Depot Inc. is feeling more optimistic about the recovery of the housing market after customers spent more on remodeling and repair projects in the second quarter.

The country's biggest home-improvement retailer said Tuesday that stronger sales of paint, bath accessories and kitchen installations helped lift its net income by 12 percent during the period. Lower costs also contributed to the improved results.

The Atlanta-based company boosted its full-year earnings outlook, citing its performance so far this year.

Chairman and CEO Frank Blake noted in a conference call with investors that some of the strongest growth came from the markets that were hit hardest in the downturn, such as California and Florida.

"These are encouraging signs of stabilization in the housing market," Blake said.

When the housing market is weak, companies such as Home Depot struggle because new construction slows and contractors don't spend as much on supplies. Homeowners also pull back on projects, such as kitchen or bathroom renovations.

In the latest quarter, however, Home Depot said it saw signs of improvements in key areas.

Overall, revenue at stores open at least a year rose 2.1 percent. In the U.S., where the majority of Home Depot's stores are located, the figure rose 2.6 percent. The metric is a key gauge of a retailer's health because it strips out the impact of recently opened or closed locations.

Sales of spray paint, laminated flooring and area rugs saw double-digit sales growth, the company said. Sales of paint, bath accessories, special order carpeting, window treatments and wood flooring also improved.

Transactions of $900 or more, which make up about 20 percent of U.S. sales, rose 3.4 percent in the quarter, as appliance, kitchen and flooring sales increased. Transactions of $50 or less, which also make up about 20 percent of sales, were down 0.7 percent.

The company attributed the decline to the warm winter, which it said pulled sales of seasonal items, such as gardening products, into the first quarter.

Home Depot's total operating expenses also eased to $4.46 billion during the quarter, down 3 percent from a year ago. The improvement was partly the result of a new regulation that caps the amount banks can charge retailers when customers pay with debit cards.

In the second half of the year, however, Home Depot expects expenses to rise as it spends on new call centers and other operational improvements.

Looking ahead, Home Depot now expects fiscal 2012 earnings of $2.95 per share, up from the $2.90 per share it previously forecast. Sales are still expected to rise 4.6 percent, implying revenue of $73.63 billion.

Analysts expect earnings of $2.92 per share on revenue of $73.95 billion.

Home Depot runs more than 2,200 stores. Its smaller rival Lowe's Cos. reports its earnings Monday.

Shares of Home Depot rose $1.60, or 3 percent, to $54.42 in morning trading.

ScienceDaily ? University of Michigan study the first to show evidence that mindfulness yoga may offer effective treatment for depressed new mothers to be. Prenatal yoga may help women cope with depression.

It?s no secret that pregnancy hormones can dampen moods, but for some expectant moms, it?s much worse: 1 in 5 experience major depression.

Now, new research shows that an age-old recommended stress-buster may actually work for this group of women: yoga.

Pregnant women who were identified as psychiatrically high risk and who participated in a 10-week mindfulness yoga intervention saw significant reductions in depressive symptoms, according to a University of Michigan Health System pilot feasibility study. Mothers-to-be also reported stronger attachment to their babies in the womb.

The findings were published inComplementary Therapies in Clinical Practice.

?We hear about pregnant women trying yoga to reduce stress but there?s no data on how effective this method is,? says lead author Maria Muzik, M.D., M.S., assistant professor of psychiatry and assistant research scientist at the Center for Human Growth and Development. ?Our work provides promising first evidence that mindfulness yoga may be an effective alternative to pharmaceutical treatment for pregnant women showing signs of depression.

?This promotes both mother and baby wellbeing.?

Mental health disorders during pregnancy, including depression and anxiety, have become a serious health concern. Hormonal changes, genetic predisposition and social factors set the stage for some expectant moms to experience persistent irritability, feelings of being overwhelmed and inability to cope with stress.

Untreated, these symptoms bear major health risks for both the mom and baby, including poor weight gain, preeclampsia, premature labor and trouble bonding with the new baby.

While antidepressants have proven to effectively treat these mood disorders, Muzik says, previous studies show that many pregnant women are reluctant to take these drugs out of concern for their infant?s safety.

?Unfortunately, few women suffering from perinatal health disorders receive treatment, exposing them and their child to the negative impact of psychiatric illness during one of the most vulnerable times,? Muzik says. ?That?s why developing feasible alternatives for treatment is critical.?
